Kelly, the suspected rapist claims he attempted intercourse with the woman to warm her and save her life after he found her unconscious outside her apartment.
The victim says she came to and found some bruises on her upper thighs. She then believed she had been raped.
Kelly now faces a first degree rape charge. His bail has been set at $25,000 (N4 million).
